1. Agreement Overview

By renting a trailer from Ricky D’s Trailer Rentals (ABN: 27 327 267 330) (“the Company”), you (“the Hirer”) agree to the following terms and conditions. These terms are binding upon acceptance during the online booking process via rentwithricky.com.au.

2. Rental Period and Charges

  • Bookings are charged in 24-hour increments, irrespective of the usage duration within this time frame.

  • Discounts may apply for longer rental periods.

  • The rental period begins at the agreed pick-up time and ends at the agreed drop-off time. Late returns will incur additional charges.

3. Hirer Responsibilities

The Hirer must:

  • Use the trailer solely for its intended purpose and in compliance with all road and safety regulations.

  • Return the trailer in the same condition as received, excluding normal wear and tear.

  • Ensure the trailer is properly secured at all times when not in use.

  • Not sublet, transfer, or allow unauthorized persons to operate the trailer.

4. Permitted Use and Restrictions

The Hirer agrees to the following usage restrictions:

  • The trailer must only be towed by a registered vehicle equipped with a functioning tow bar that meets the trailer’s weight specifications.

  • The trailer must remain connected to the towing vehicle at all times when in use. It must not be detached and used for standalone purposes.

  • The trailer must not be used on unsealed, off-road, or non-maintained roads unless prior written permission is obtained from the Company.

  • The trailer must not be overloaded beyond its specified carrying capacity. Overloading will void all coverage options.

  • Prohibited uses include but are not limited to: towing in flood-prone areas, misuse, or illegal activities.

5. Damage, Loss, and Theft

  • The Hirer is fully liable for any damage, loss, or theft of the trailer during the rental period, irrespective of fault.

  • In the event of theft, the Hirer must immediately report the incident to the police and provide a copy of the police report to the Company within 24 hours.

  • The cost of repairs or replacement will be billed to the Hirer. If payment is required, the Hirer agrees to pay the amount within 14 days.

6. In-House Damage Coverage Options

The Company offers in-house coverage tiers to reduce the Hirer’s financial liability during trailer rentals:

  1. Basic Cover ($9.99 per rental):

    • Includes coverage for accidental damage repairs up to $100.

    • Covers minor repairs like plugs, bulbs, or side markers.

    • Ideal for short rentals or minimal-risk situations.

  2. Standard Cover ($49.99 per rental):

    • Includes coverage for accidental damage repairs up to $200.

    • Covers , minor metalwork fixes, or ramp repairs.

    • Recommended for renters seeking balanced protection.

  3. Premium Cover ($199.99 per rental):

    • Includes coverage for accidental damage repairs up to $1,500.

    • Comprehensive coverage includes structural repairs, Suspension repars and more.

    • Perfect for long-term rentals or higher-risk scenarios.

The chosen coverage tier must be selected at the time of booking. Coverage excludes:

  • Intentional or negligent damage.

  • Theft due to insufficient security measures.

7. Incident Reporting and Evidence Collection

To ensure swift resolution of any incidents, the Hirer must:

  • Immediately Notify the Company:
    Report any damage, theft, or accidents involving the trailer as soon as it occurs.
    Contact the Company at info@rentwithricky.com.au or via other provided communication channels.

  • Document the Incident:

    • Photographs: Clear images of the damage, surroundings, and other vehicles involved (if applicable).

    • Details: Record dates, times, and precise locations of the incident.

    • Witness Statements: If possible, collect contact details and statements from witnesses.

    • Police Report: For theft or major accidents, the Hirer must file a report with the police and provide a copy to the Company within 24 hours.

  • Secure the Trailer:
    In case of damage or mechanical failure, the Hirer must take reasonable steps to protect the trailer from further harm until it is returned to the Company.
    For theft, the Hirer must provide evidence that the trailer was properly secured (e.g., photographs of locks or chains in use).

Failure to comply with these requirements may result in the Hirer being fully liable for damages or losses.

8. Liability

The Company shall not be liable for:

  • Any injury, loss, or damage suffered by the Hirer, third parties, or property due to the use or misuse of the trailer, including any consequences of improper loading, overloading, or failure to adhere to road safety regulations.

  • Any delays, cancellations, or inconveniences caused by mechanical failure, accidents, or unforeseeable events beyond the Company’s control.

  • Any costs incurred as a result of traffic violations, fines, or toll infringements during the rental period.

The Hirer assumes full responsibility for any loss, damage, or injury caused while the trailer is in their possession, except in cases where the Company is proven to be grossly negligent.

9. Cancellation Policy

  • Cancellations made more than 48 hours prior to the rental period will receive a full refund.

  • Cancellations within 48 hours may incur a cancellation fee of 50% of the booking amount.

5. Consumer Guarantees

This policy does not exclude or replace your rights under Australian Consumer Law. If goods fail to meet consumer guarantees, you are entitled to a remedy.

Terms and Conditions (TOC) – Ricky D’s Trailer Trackers

1. Agreement Overview

By purchasing a GPS tracking device and subscription from Ricky D’s Trailer Trackers (“the Company”), you (“the Customer”) agree to the following terms and conditions. These terms apply to all devices, subscriptions, and services provided.

2. Subscription Plans

  • Monthly Plan: $14.99 per month

  • Yearly Plan: $110 per year

  • 2‑Year Plan: $220 for 24 months

Additional conditions:

  • Payments are processed securely via Stripe.

  • All plans auto‑renew unless cancelled before the renewal date.

  • If a payment fails, the device and platform access may be suspended after 7 days until payment is restored.

  • All plans are fixed‑term. Early cancellation requires payment of the remaining balance.

3. Account Setup & Device Assignment

  • A Telematics Guru (TG) account will be created using the Customer’s email.

  • The purchased device will be pre‑assigned to the Customer’s TG account before shipping.

  • Login details and instructions will be emailed to the Customer.

4. Device Ownership, Installation & Use

  • Devices are purchased outright and become the Customer’s property.

  • The Customer is responsible for correct installation and securing the device to their asset.

  • Battery‑powered devices typically operate for extended periods; actual battery life varies based on usage, reporting frequency, and environmental conditions.

  • The Customer must not tamper with, modify, or misuse the device.

5. Service Limitations & Asset Recovery

GPS tracking relies on mobile networks, GPS signal, battery level, and environmental conditions. Because of these factors, tracking accuracy and availability may vary.

The Company does not guarantee the recovery of any stolen or lost asset. Tracking data is provided on a best‑effort basis only.

The Customer accepts full responsibility for their asset and understands that the tracker is a tool to assist with monitoring, not a guaranteed recovery service.

6. Third‑Party Software (Telematics Guru)

  • Tracking services are delivered through Telematics Guru (TG).

  • By using the service, the Customer agrees to TG’s Terms of Service and Privacy Policy.

  • TG manages data processing, mapping, and reporting functions.

7. Data Collection & Privacy

  • Location and movement data is collected solely for tracking purposes.

  • Data is stored securely and shared only with authorised users.

  • The Customer must comply with Australian privacy laws when tracking assets used by other individuals.

8. Cancellation, Refunds & Warranty

  • Subscriptions are non‑refundable once activated.

  • Early cancellation requires payment of the remaining subscription term.

  • Devices include a 12‑month hardware warranty covering manufacturing faults only.

  • Warranty excludes damage caused by misuse, water ingress, incorrect installation, or battery depletion.

9. Liability

To the maximum extent permitted by Australian law, the Company is not liable for:

  • Loss, theft, or failure to recover any asset.

  • Any indirect, incidental, or consequential damages.

  • Issues arising from network outages, GPS signal loss, battery depletion, or environmental interference.

  • Customer‑configured settings that affect reporting frequency or battery life.

The Customer is responsible for ensuring their device remains powered and their subscription active.

By purchasing a device or subscription, the Customer acknowledges and agrees to these terms and conditions.
